Bélanger Paradis avocados (hereinafter “) BPA avocados ”) is a law firm specializing in civil and commercial litigation and construction law. As part of our business relationships with customers, third parties, and when providing services, we collect and maintain personal information from our customers and third parties.

Recognizing the importance of protecting the personal information we collect, we have established this Privacy Policy (hereinafter “Policy”), which is established in accordance with the Private Sector Personal Information Protection Act.

By dealing with BPA avocados, you consent to the collection and use of your personal information in accordance with this Policy.

You can at any time deactivate certain types of storage that may not be necessary for the basic functioning of the website. However, blocking categories can impact your experience on the website.

Purpose of the Policy

The purpose of this Policy is to inform you about the internal process for collecting, maintaining, using and destroying personal information, to present the rules for the treatment of personal information, to explain the role and responsibility of the members of the BPA avocados team and also to inform you about your rights in compliance with personal information.

Personal information collected

Personal information is information that concerns a natural person and that allows the individual to be identified, directly or indirectly.

A lot of personal information may be collected when you transact with BPA avocados, such as:

BPA avocados collects personal information directly from you during our professional exchanges or when you communicate with us by email or telephone.

We may also collect personal information from third parties when we obtain consent to do so or when authorized or required by law.

Reasons why personal information is collected

The personal information collected by BPA Avocats is used exclusively:

  • In order to provide legal services and to execute the mandate given;
  • To ensure the invoicing of our files and the collection of our debts;

  • For any other purposes granted.

Persons who have access to the personal information collected

Staff members of BPA avocados have access to personal information when required in the performance of their duties. Under no circumstances is it allowed to consult, use or communicate this information except for the execution of the tasks for which the data was collected.

BPA avocados may share personal information held with the following third parties:

  • IT service provider (backup and backup copy);
  • External expert or professional hired as part of our professional services;
  • Third parties if required by law;

Retention and destruction of personal information

Personal information is stored with our IT service provider, hosting and data storage provider. All personal information collected is located exclusively in Quebec. Both the IT service provider and BPA lawyers are subject to applicable Quebec laws concerning the protection of personal information.

Sometimes hard copies of our records that include the personal information they contain are used by employees. These hard copies are stored securely in our physical offices.

BPA Avocats ensures that personal information is kept only for as long as is necessary for the purposes for which it is used. We are required to keep all of our records for a period of 7 years following closure under Regulation on accounting and standards of professional practice for lawyers. All personal information is therefore kept in the file concerned.

When personal information is no longer required and the legal and regulatory retention period is prescribed or has expired, we permanently and securely delete the personal information obtained.

Security of personal information

All members of our staff are subject to a duty of confidentiality in relation to the personal information they consult in files or use in the course of their work.

All service providers and other third parties who may receive personal information are also contractually bound by obligations of confidentiality and protection of personal information.

Security incident

Despite all the protective measures put in place by BPA avocados, we cannot guarantee that no security incident can occur, for example; an intrusion into our database.

If such an accident occurs, BPA avocados is committed to taking the necessary measures to reduce the harm that the accident could cause and to prevent it from happening again.

Rights and obligations with respect to your personal information

You have the right to request access to and correction of your personal information, except where the Law allows or requires us to refuse access to it.

We will follow up on any request for access or correction of information within 30 days of receiving the request.
